For elections governed by California’s HOA secret-ballot requirements, Civil Code § 5110(a) requires the association to select one or three independent inspectors of elections. Section 5110(b) expressly recognizes notaries public as eligible inspectors, subject to independence requirements. An inspector cannot be a director, a candidate for director, a person related to either, or someone currently employed by or under contract with the association for paid services other than serving as its election inspector.

We keep these roles separate. When serving as your association’s election inspector, we do not also provide paid board administration, routine records maintenance, or other non-inspector services to that association.
